These website terms and conditions of use for adhdnurse.ca constitute a legal agreement and are entered into by and between you (hereinafter referred to as “You” or the “User”) and ADHD Nurse ("Company," "we," "us," "our"). The following terms and conditions, together with any documents and/or additional terms they expressly incorporate by reference (collectively, these "Terms and Conditions"), govern your access to and use of, including any content, applications, websites, products, functionality, and services offered on or through adhdnurse.ca (the "Website").
Services provided by healthcare providers are registered to practice in a province or territory of Canada (collectively, “Authorized Providers”) and certain other health-related services. Healthcare services may be delivered through interactive text, audio and/or video technology, where the patient and the healthcare provider are not in the same physical location (such services are referred to in these Terms collectively as “Healthcare Services”).
The website enables information and other documents provided by You including personal health information (collectively “PHI”), to Authorized Providers electronically. Users may represent individuals or provide PHI for whom they have legal rights to make healthcare decisions (“Representative Dependents”) and use the Website on their behalf. For clarity, nothing in these Terms requires ADHD Nurse to accept any Representative Dependent as a User, notwithstanding that the registrant meets ADHD Nurse eligibility requirements as amended from time to time. Supplementary Terms specific to certain users may also apply. Supplementary Terms are incorporated into and become part of these Terms.

IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS OR THE PRIVACY POLICY, YOU MUST NOT ACCESS OR USE THE WEBSITE.
By using this Website, you represent and warrant that you are of the legal age of majority under applicable law to form a binding contract with the Company and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Website.
Eligibility
You represent and warrant (promise) to ADHD Nurse and acknowledge that ADHD Nurse is relying on your representations and warranties that:
(a) You and your Representative Dependents must be at least 18 years of age, be associated with and meet the age and other eligibility requirements established by an insurance provider and be a temporary or permanent resident of a province or territory of Canada (“Residency Requirements”).
User representations and warranties
You represent and warrant (promise) to ADHD Nurse and acknowledge that ADHD Nurse is relying on your representations and warranties that:
(a) You and the Representative Dependents meet the Residency Requirements and will continue to do so at the point in time that request and that Healthcare Services are provided;
(b) You are authorized to act for your Representative Dependents and more particularly to make decisions regarding their healthcare; and
(c) You will the Website solely for your personal and non-commercial use.
Nature and Scope of Healthcare Services
(a) Authorized Providers, Relationship with Users. Only regulated health professionals (Authorized Providers) may provide Healthcare Services to Users through ADHD Nurse Healthcare Services. Authorized Providers maybe Authorized Nurses or Authorized Non-Nurses Providers. “Authorized Nurses” are nurses registered to practice medicine in at least one province or territory of Canada. “Authorized Non Physician/Nurse Providers” are regulated health professionals other than physicians/nurses (such as psychotherapists) registered to practice their profession in a province or territory of Canada.
(b) Not a Replacement for Primary Care. Healthcare Services do not take the place of appointments with regular primary care provider. If you do not have a primary care provider, we encourage to you find one. ADHD Nurse does not provide your primary care provider with a report of the Healthcare Services that you receive unless You make a request with your written consent.
(c) Not a Replacement for Medical Advice by a Primary Care Provider. ADHD Nurse does not provide medical advice and/or is not a replacement for physician medical advice, diagnosis, or treatment. ADHD Nurse doess not provide or respond to medical emergencies or mental health crises. Any electronic messages and voicemails will not be checked by ADHD Nurse on a regular basis that could possibly alert or support an emergency and crisis management situation. IF YOU BELIEVE THAT YOU ARE DEALING WITH AN EMERGENCY, YOU WILL CALL 911 IMMEDIATELY OR GO TO YOUR NEAREST EMERGENCY ROOM.
Modifications to the Terms and Conditions and to the Website
We reserve the right in our sole discretion to revise and update these terms and conditions from time to time. Any and all such modifications are effective immediately upon posting and apply to all access to and continued use of the Website. You agree to periodically review the terms and conditions in order to be aware of any such modifications and your continued use shall be your acceptance of these.
The information and material on this Website may be changed, withdrawn, or terminated at any time in our sole discretion without notice. We will not be liable if, for any reason, all or any part of the Website is restricted to users or unavailable at any time or for any period.
